With the evidence provided, I would say that this case is a no-brainer for the plaintiff.
Conan O'Brien said he was inspired by the lawsuit filed by the "Nirvana Baby" Spencer Elden, who is saying that he suffered “permanent harm” because of his association with the album, including emotional distress and a “lifelong loss of income-earning capacity.” Conan feels the same way after his parents knowingly took this photo of him as a kid.
