As Nate Rancloes rejoined his friends on the sand with his food from the concession stand, a seagull swooped in and started munching on his burger.
In an effort to shoo the winged cheeseburgler away, Rancloes swung his leg around and kicked the federally protected bird.
Witnesses not sympathetic to the now hungry Rancloes, reported him to police, who slapped him with a $124 fine.
