A California man is being accused of backing up his truck into three people sitting outside of a bar in San Jose, resulting in the death of one of them.
Police say 32-year-old Alex Moreno was drunk, high, and was receiving oral sex in the truck when the accident occurred.
Diana Prieto-Chacon, 35, died of her injuries. Two men she was sitting with suffered serious leg injuries.
According to a police report, Moreno and an unidentified 24-year-old woman were kicked out of Agave Sports Bar and Grill after Moreno appeared to be heavily intoxicated, was seen using cocaine, and attempted to take off another woman's top.
Moreno and the 24-year-old voluntarily left and got into Moreno's truck parked outside of the bar.
The woman told police that she began performing oral sex on Moreno. At one point, the truck began moving in reverse at speed "up to 45 mph" before crashing into the victims.
The two say they do not recall being in the crash, according to the police report.
Moreno is being charged with gross vehicular manslaughter and driving under the influence causing injury.
