Grandma Arrested at Disney World for Having CBD Oil in Purse

A 69-year-old grandmother with arthritis was arrested at Disney World for having CBD oil in her purse.

Hester Burkhalter from North Carolina had planned her Disney World vacation for over two years but was stopped at a checkpoint and a police officer found the oil on her. She then spent 12 hours in jail and was released on a $2,000 bond.

Burkhalter says her doctor recommended using CBD oil to treat arthritis in her legs, shoulder and arms, of which can be purchased off of store shelves in Florida. "I use it for the pain because it helps," she said.

Hester even had a note from a medical professional in her purse at the time regarding the CBD oil. The oil is technically illegal in Florida without having a prescription for it and police determined that Ms. Burkhalter's note was not a prescription.

An attorney in Florida noted, "a little drop of oil, with the CBD, is a felony. Meanwhile, you can have up to 19.9 grams of leaf-marijuana, and it's a first-degree misdemeanor."

The Orange County Sheriff's Office defended the actions of the deputy who arrested Hester, saying he acted only on the law in Florida.

The charges against Burkhalter were later dropped.
